Terms And Conditions

0. Definitions

A. "Vintage Radio", "Vintage Radio and Television", "Site", "Owner", "Us", "Our" & "We": Vintage Radio and Television, located at vintage-radio.com.au.

B. "You" & "Your": The End User of this website or any website under our control.

1. Application

A. This agreement together with the Vintage Radio and Television Acceptable Use Policy, Vintage Radio and Television Privacy Policy any additional terms, conditions, notices and disclaimers contained elsewhere on Vintage Radio and Television form the conditions of supply of content on, and use and access to Vintage Radio and Television.

B. Your use of Vintage Radio and Television constitutes your acceptance of and agreement to these terms. Failure to observe your responsibilities and obligations under these Terms and Conditions may result in your permanent removal from this site and related services and any other such action allowable under applicable laws. At this stage we will not be responsible for a loss or other inconvenience suffered by you as a result of our actions resulting from your non-compliance.

C. If you disagree with any part of these Terms and Conditions you must remove yourself from this site forthwith and not return until you have the capacity and intention to comply in full.

2A. Operative

A. The site is owned by Mr B J Leet, located in New South Wales, Australia; from here, known as "The Owner".

B. The owner reserves the right to appoint people to hold positions of delegated authority, to assist with the administration of this website in accordance with these Terms and Conditions. The owner also reserves the right to remove any person from any appointed position at any time, with or without a reason, with or without notice.

C. Any person appointed to a position of delegated authority is required to observe a code of conduct in addition to other site membership requirements.

2B. Relationship

A. Members and guests who visit this website do so as normal consumers of website content. The status of a partnership between a member or guest and this website does not exist at any time. Any claim to the contrary is not endorsed by the owner of this website.

B. This website is not affiliated with any club, association, society or other like organisation with regard to vintage radios or any other items. Any claim to the contrary is not endorsed by the owner of this website.

C. Third party links allowing navigation from this website to any other website is not an indication that any partnership, affiliation or alliance exists between the owners of this website and the linked site. Links are provided as a service to members and guests and for no other reason.

D. It is a standing order that no request or invitation to accept a partnership or affiliation status from any other party be entertained or acknowledged. The neutrality of the website will remain its most important asset.

3. Use of content included on Vintage Radio and Television

A. All information, text and images included on Vintage Radio and Television is for personal use only and may not be re-written, copied, re-sold or re-distributed, framed, linked or otherwise used whether for compensation of any kind or not, without first receiving our prior written permission.

B. Where the Commonwealth Copyright Act, 1968, allows content to be reproduced on a website for the purpose of 'fair review', or Vintage Radio and Television has granted permission for content to be reproduced for any other reason, you must provide immediately adjacent to, a crawlable link (ie: exclude 'REL=NOFOLLOW' attributes and DISALLOW statements in robots.txt) to Vintage Radio and Television and a statement with words to the effect "Content/Image courtesy of Vintage Radio and Television".

C. Where the Commonwealth Copyright Act, 1968, allows content to be reproduced in print form for the purpose of 'fair review' or Vintage Radio and Television has granted permission for content to be reproduced for any other reason, you must provide immediately adjacent to, text which suitably identifies the source of the material you are reproducing, which shall include the URL to the front page of this website.

D. In all cases of reproduction you must suitably space the reproduced material from your own so that your visitors cannot interpret the reproduced material as being part of the normal content of your website or print media.

4A. Accuracy of content

A. Vintage Radio and Television and content included here are published for information purposes only without assuming a duty of care. Vintage Radio and Television is not in the business of providing professional advice, and gives no warranty, guarantee or other representation about the accuracy of the information or images contained within. Vintage Radio and Television is not liable for errors, omissions in, delays or interruptions to or cessation of the site through negligence or for any other reason.

4B. Accuracy and ownership of content provided by members

A. Ownership of all content submitted by Vintage Radio and Television members remains the property of the person posting it however responsibility for submitted content also remains with the member who supplies it. Members agree that when submitting any content they will hold Vintage Radio and Television harmless in respect to any action taken by a third party in relation to the content supplied by the member.

B. Members grant to Vintage Radio and Television an unconditional, irrevocable, world-wide licence to reproduce any submission made by them as Vintage Radio and Television sees fit and for as long as Vintage Radio and Television deems necessary. Vintage Radio and Television reserves the right to modify any submission either before publication or after publication at any time and without notice for any reason or without a reason and reserves the right to refuse to publish and/or subsequently destroy any submission before or after publication, at any time without notice for any reason or without a reason.

4C. Establishing a link between legal entities (real people or corporate) and generic information

A. When an article, comment or other content on Vintage Radio and Television relates to a specific issue and a possible relationship with a real person or corporate entity is assumed by a third party, that relationship shall be deemed to be entirely co-incidental unless a definite link has been established by the author of the content in question. This link must include either the name of a real person or the legal identity of a corporate entity. No claim of mis-representation will be considered without the establishment of a definite link to one or more of the above-mentioned entities.

B. The burden of proof lies with the informant.

5A. Guarantee of the integrity of the platform

A. The website is hosted on a server connected to the public Internet. As such, whilst all reasonable efforts are made to protect all information posted to the site, the owner will accept no responsibility what-so-ever for the results of the following:-

I. An attack by a hacker or other form of illegal entry to the site.
II. Theft of and/or distribution of any data by persons mentioned above.
III. A hardware malfunction, causing a partial or complete, temporary or permanent loss of data.
IV. A software malfunction, causing a partial or complete, temporary or permanent loss of data.
V. A network failure that causes a temporary or permanent inability for someone to access the site.

5B. Limitation of liability

A. To the maximum extent permitted by law, Vintage Radio and Television excludes all liability to any person for loss or damage of any kind arising from or relating in any way to the content included on Vintage Radio and Television and/or any use or misuse of Vintage Radio and Television. Where any law implies a warranty into these terms of use which may not be lawfully excluded, then to the maximum extent permitted by law, our liability for breach of the warranty will at, our sole option, be limited to the re-supply of the relevant service or the payment of the cost of having that service resupplied.

5C. Complaints and other Feedback

A. All members have the right to make a complaint if they genuinely feel they have been wronged on Vintage Radio, or to provide other feedback. The only way to lodge a formal complaint or other feedback at this time is via e-mail to the Administrator. Complaints will always be dealt with fairly and in accordance with the Terms of Use and Acceptable Use Policy. A complainant will be informed of the Administrator's decision once the details of the complaint have been dealt with and that decision will be final. No further correspondence will be entered into.

B. No other form of communication with regard to complaints or feedback is accepted, unless by prior arrangement with the Administrator. Members who use other forms of communication without the express consent of the Administrator will simply have their communication ignored until it is lodged via e-mail. Members who are not compliant with this clause risk being suspended or banned from the site.

6. Copyright

A. Unless otherwise stated, Vintage Radio and Television reserves all copyright in the content and design of the site. Vintage Radio and Television owns all such copyright or uses it under licence or applicable law.

B. You may view Vintage Radio and Television and our content using your web browser and make a temporary copy of all or part of the site for your personal use only. The provisions outlined in Section 3, Paragraph B also apply.

7. Trade marks and intellectual property

A. Vintage Radio, Vintage Radio and Television, vintage-radio.com.au and the 'VR' logo are trademarks or registered trademarks belonging to the owner of Vintage Radio and Television.

8. Applicable laws

A. These terms of use and all other specific and additional terms which govern your use or access to Vintage Radio and Television will be governed and construed in accordance with the laws in force in the state of New South Wales. All parties will irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales.

B. If any of these Terms of Use are invalid or unenforceable, it will be struck out and the remaining terms will remain in force.

C. If we do not act in relation to a breach by you of these Terms of Use, this does not waive our right to act in retrospect or with respect to subsequent or similar breaches.

D. You may not assign or transfer your rights or benefits under these Terms of Use to any other person or entity without the prior written consent of Vintage Radio and Television.
